FG Urges Abuja Court To Dismiss Suit Challenging Legitimacy Of Confab....

The Federal Government has urged a Federal High Court sitting in Abuja to dismiss the suit filed by human rights activist, C to challenge the powers of President Goodluck Jonathan to convene the ongoing national Confab. In his suit, Abayomi had argued that the complaints that warranted the call for a national conference were based on the need for the country’s culturally and religiously diverse people to agree on the terms of their relation in a free national dialogue originated by the freewill of the people.

After branding the ongoing conference “a political council with politically directed interests and personalities”, he argued that President Jonathan lacks the powers to convene the conference without an authoring legislation from the National Assembly. He therefore prayed the court to declare the conference null and void.
He listed the Federal Government, Attorney General of the Federation (AGF), Senate President, Speaker of the House of Representatives, and Chairman and Vice Chairman and Secretary of the conference as defendants in the suit.
But in its notice of preliminary objection, the Federal Government argued that the plaintiff lack the locus standi to initiate the suit and questioned the jurisdiction of the court to hear the suit.
Maintaining that the president withholds the constitutional powers to convene the conference, FG’s lawyer, Femi Falana (SAN) said the plaintiff failed to disclose any course of action against the defendants.
Presiding judge, Justice Abdul Kafarati adjourned hearing on the matter to 8th May 2014

A Federal High Court in Abuja on Monday gave an order of perpetual injunction restraining the lawmakers who defected from the Peoples Democratic Party, PDP, to the All Progressives Congress, APC, from effecting any leadership change in the House of Representatives.
Delivering judgment, Justice Adeniyi Ademola lambasted the decampee lawmakers. He said they no longer had any business, morally and legally, to stay in the House of Representatives.
He said they should honourably resign from their seats as members, having moved to another political party while their tenure had yet to expire.
“Having perused the arguments of counsel and the constitutional provisions, it is clear and unambiguous that the defendants were sponsored by the PDP and won the election on its platform. It is also the court’s opinion that their tenure has not expired and there is no division in the PDP.

“This is not 1993 and whether we like it or not we must accept the fact that religion plays a major role in our politics today.”
A chieftain of the All Progressives Congress, APC, and former Aviation Minister, Femi Fani-Kayode, has cautioned the party against fielding an all Muslim presidential ticket in next year’s polls.
In a statement on Monday, Mr. Fani-Kayode said the APC would lose “woefully” if they present a Muslim-Muslim ticket in the 2015 presidential election.
“I have said it privately in countless political meetings and I will say it publicly today. Please mark it – the biggest mistake that my party, the APC, can make is to field a Muslim/Muslim ticket in the 2015 Presidential election. If we do that we will not only offend the Christian community, but we will also lose the election woefully,” Mr. Fani-Kayode said.
In the 1993 presidential election, the Social Democratic Party, SDP, had fielded M.K.O Abiola and Baba Gana Kingibe – both of them staunch Muslims – and still went ahead to garner a landslide victory in the annulled election.

APC and Minority Leader of House of Representatives, Femi Gbajabiamila has described Monday’s ruling by the Federal High Court, Abuja as a strange judgment that turned law on its head.
In reflecting on the judgment he said the judgment is a product of error of court the lawmakers would be willing to appeal at a higher court.
“The judgement is strange and will be appealed. No person can be compelled by law to stay in an association against his or her wishes.”
Gbajabiamila also said that the judgment is an affront to right of association of the lawmakers.
“It negates a fundamental right of association of every citizen that is inalienable. Section 68 of the constitution has been turned on its head and the error of the court is manifest”
“Section 68 was never argued in court by any of the parties. The judge gave an opinion he was never asked to give and an argument that was never canvassed in court”

The prayer session was organised by the Cathedral in Life Camp, Gwarimpa, Abuja, as part of activities to mark the 2014 Mothering Sunday celebration which had “ Let Your Light Shine’’ as its theme.
Mrs Ngozi Ikeliani, the Chairperson of the Cathedral told reporters that the celebration signified a day that the Church recognised the importance of women in the worship of God.
She said “we asked God for peace, protection and defence of all Nigerians against all assaults of enemies.

Mazzarri scooped up a water bottle in front of him with his teeth before chomping down, in a bid to get rid of the anger.
The moment of madness only lasted seconds, but it was captured on Italian TV for us to all enjoy. Poor Mazzarri, the season will be over soon enough…

Chelsea manager Jose Mourinho has called out a Crystal Palace ball boy after the Special One felt the kid was wasting time as the Eagles beat the Blues 1-0 on Saturday.
Towards the end of the match at Selhurst Park, a ball boy was accused of mucking around with the Chelsea players as he took his time throwing a ball to Blues full-back Cesar Azpilicueta.
Remembering the incident last season at Swansea when Eden Hazard kicked a ball boy, Mourinho stepped into the fray, put his hand on the young boy to draw him in close, before whispering something in his eye which one can only assume for some parenting tips from the Chelsea manager.
After the game Mourinho spoke about the incident with the ball boy, and the Blues boss called out the Palace kid for unruly behaviour. Mourinho said:
I don’t like the ball boys provoking the players. Because at the end of the day what happens it what happened last year at Swansea when a player loses a bit his temper and after that the player is guilty of something that the player is not guilty. I dont think it’s right to educate kids like that.
I told the ball boy not to do that because he runs the risk of one of my players punching him or losing his temper. Someone told him to do that.
I went there to stop Azpilicueta… All my four defenders are phenomenal in their attitude.

Jonathan suggests international conspiracy in arms flow to Boko Haram
President Goodluck Jonathan has spoken of the likelihood of an international conspiracy aimed at fuelling insurgency in Africa to curb the continent’s growth, raising the possibility of extremist Boko Haram and other networks drawing their increasingly sophisticated weapons from “external forces”.
Mr. Jonathan spoke on Saturday in Abuja in an address to delegates to the joint annual meeting of the ministers of finance, planning, and economic development of the Economic Community of Africa, and those of the African Union.
The conference, which has as its theme: “Industrialization for Inclusive and Transformative Development Agenda”, is attended by African leaders as well as heads of international and regional development institutions and agencies.
Mr. Jonathan said it was worrisome that children who can hardly fend for themselves economically are the ones wielding sophisticated weapons used by the insurgents like Boko Haram to attack and destabilize the country.

The Department of State Services has issued a statement, claiming that the sustained gun battle around its headquarters and the vicinity of the presidential villa this morning began after a detainee disarmed an operative and tried to effect a jailbreak.
“At 0715 hours, the Service suspect handler went to the detention facility within the Headquarters to feed the suspects,” the SSS spokesperson, Marilyn Ogar, said in the statement. “One of the suspects attempted to disarm him by hitting him at the back of his head with his handcuff. His attempt to escape drew the attention of other guards at the facility who fired some shots to warn and deter others.
“The gun shots attracted the attention of the military with whom we have an understanding of mutual assistance in the event of any threat. The Army immediately deployed a team to reinforce our perimeter guards to forestall any external collaborators. The situation has since been brought under control.”
But knowledgeable security sources are telling PREMIUM TIMES that the SSS narrative begs further questions because they are “untrue and misleading”.
The sources frame their doubts around the presumed impenetrability of the DSS facility and headquarters; the unusually huge military intervention force; the quality of ordinance deployed; and the prolonged period of gun exchange.

He regretted that the party was not concerned about the plight of the common man, adding that what matters to the PDP is how long it would rule the country. Tinubu spoke in Lagos at the 6th annual Bola Tinubu Colloquim titled: “ The Summit 0f The Common Man”
His words: “The common man lives below poverty line which is measurable by all standards in the world. We have heard about a farmer who was defrauded through their fertilizer scheme. Yet they talk about SURE-P of corruption. This is a reminder about the type of leader we have in the country. We must be compassionate. We need an enduring change that is not along relegious lines. No matter how rich you are since you are African, you must still have a link with poverty. It could either be through your mother, uncle or any relation. We have to break that shackle.”

PRESIDENT Goodluck Jonathan yesterday took a swipe at governors for accusing the Federal Government of bad leadership, asking them to stop pushing blames when they have failed on their part to provide primary and secondary education for their citizens.

Speaking in Bauchi during the North-east Zonal Rally of the Peoples Democratic Party, PDP, Jonathan also lampooned some northern governors over insurgency in their states which he blamed on lack of education for the children and employment consequent upon which they are ready tools for terrorists.
Jonathan, who charged the governors to take charge and stop blaming their inept leadership on the Federal Government, however asked if the federal government, constitutionally responsible for the provision of tertiary education, should be in charge of primary and secondary education at the state level.
He said, “ Sometimes governors will come and say we have some issues because of bad leadership. I was governor, deputy governor before I became a governor. I spent eight years at the state level, I handled security challenges. That was the state where the first commercial kidnapping took place because of excess militancy.

The prolonged gun battle around the headquarters of the Department of State Services and the presidential villa did not endanger President Goodluck Jonathan in any way, a presidential spokesperson has said.

The Special Adviser to the President on Media and Publicity, Reuben Abati, said in a statement posted on his twitter handle [@abati1990] that Mr. Jonathan was unharmed in the shootout between the army and insurgents at the SSS headquarters.
The presidential villa, which has one of its gates overlooking the SSS headquarters, is a stone throw away from the scene of the attack.
“What happened at the SSS HQs has nothing to do with the Villa. President Jonathan is safe and well. Thank you for your concern & support,” Mr. Abati said.
He added, “What happened at the SSS HQ this morning was an attempted jailbreak which has been effectively foiled. There is no cause for alarm.”

UPDATE: 20 Boko Haram suspects killed in Abuja DSS attack.......


No fewer than 20 Boko Haram detainees have been shot dead in a shoutout that ensued this morning at the Department of State Security Service in the Asokoro a district of Abuja.
Vanguard learnt that the shoutout erupted when some of the suspected terrorists attempted to free their members and leave the detention facility, which is by the precincts of the Presidential Villa.

Trouble started around 6am during the normal handing over and taking over of duties by DSS detainees’ handlers.
A competent source said that as soon as one handlers opened the gate leading to the cell where the detainees were being kept, ten suspected terrorists rushed out, snatched the handler’s rifle and used it to shoot him.
Seeing the attack, some DSS handlers are reported to have retreated so as not to be killed by the rampaging suspected terrorists.
The source said after shooting the first handler, the ten suspected terrorists began to escape into different locations within the massive security compound.
